We strive to ensure the Website is available at all times, but we cannot guarantee that the Website will not experience downtime for any reason. We reserve the right to close the Website for short periods of time for general maintenance but will attempt to keep this to a minimum. We will not be held liable for any dysfunctionality of any part of the Website (for any reason), for any length of time.

Parts of the Website require you to input a password to access certain features. As part of our security procedures, we require you to register an account with the Company by entering your email and choosing a secure password. We recommend that you choose a strong password and log out from your account at the end of every session. If you forget your password, there is a password reset procedure. What We Offer

This website provides access to trading, pricing, news, and other information services related to diamonds and jewellery. Certain services on this website are available for members only. The website offers services for members who wish to purchase diamonds or jewellery for personal consumption, including customized and readymade jewellery. Due to screen defaults and photography techniques, some items may appear slightly larger or smaller than actual size. BLING shall not be liable for any legal action arising from such representations.

Product Details
BLING takes great care in providing product information, descriptions, and images online but will not be held responsible for any mistakes or omissions.

Definitions:

“Jewellery” refers to predesigned jewellery or jewellery set with gold and lab-grown diamonds available for sale on our website or retail stores, sold on an “as is” basis.
“Mounts” are designs that hold diamonds in place, which may or may not have diamonds. Members can select Mounts and diamonds separately to create customized jewellery.
“Loose Diamonds” are individual diamonds that can be purchased without being set on Mounts.

Trademarks

The trademarks, names, logos, and service marks (collectively “trademarks”) displayed on this website are registered and unregistered trademarks of BLING DIAMONDS LLP. Nothing contained on this website should be construed as granting any license or right to use any trademark without the prior written permission of BLING DIAMONDS LLP.

External links may be provided for your convenience, but they are beyond the control of BLING, and no representation is made as to their content. Use or reliance on any external links and the content provided thereon is at your own risk.

Warranty

No Warranty Coverage: Any jewellery purchased from BLING, through our website or authorised store, is sold without a warranty. This includes coverage for any damages, wear and tear, loss, or defects after purchase.

By purchasing from BLING, you acknowledge and agree that no warranty will apply to the products bought. If you have any questions or need further clarification, please contact us directly before making a purchase.

BLING makes no warranties, representations, statements, or guarantees (whether express, implied in law, or residual) regarding the website.

6. Pricing

Our Pricing

Taxes and delivery costs are clearly shown and invoiced at the end of the order in addition to the product prices. Our pricing is calculated using current precious metal and gem prices to give you the best possible value. These prices are subject to change due to fluctuations in precious metal and diamond prices. We reserve the right to modify our prices at any moment, prices on blingdiamonds.in and at BLING stores are subject to change without notice; however, this will be indicated on the order at the time the order is placed. The price at the time of purchase or advance payment will be considered final. Any variance between estimated and actual finished product prices will be adjusted at the time of final sale.

If an obviously incorrect price appears on our website and is not corrected on your total at the time of order completion, your order will be cancelled, and the payment refunded to you, even if it has been initially validated.

Disclaimer of Liability

BLING shall not be responsible for and disclaims all liability for any loss, liability, damage (whether direct, indirect, or consequential), personal injury, or expense of any nature whatsoever which may be suffered by you or any third party (including your company), as a result of or attributable, directly or indirectly, to your access and use of the website. This includes any information contained on the website, your or your company’s personal information, or material and information transmitted over our system. BLING or any third party or data/content provider shall not be liable in any way for any loss, liability, damage, personal injury, or expense arising from any delays, inaccuracies, errors, omissions, or non-performance, or interruption of the website.

Conflict of Terms

If there is a conflict or contradiction between the provisions of these Terms and Conditions and any other relevant terms, policies, or notices, the other relevant terms, policies, or notices which relate specifically to a particular section of the website shall prevail in respect of your use of the relevant section of the website.

Severability

Any provision of these Terms and Conditions, policies, and notices that is or becomes unenforceable in any jurisdiction shall, in such jurisdiction only and only to the extent that it is unenforceable, be treated as void, and the remaining provisions shall remain in full force and effect.

7. Cancellation and Returns

Order Cancellation:
You can cancel your orders anytime within 24 hours. Payment gateway charges of 1% may be deducted at the company’s discretion. For customized orders, making charges will be forfeited.

Refunds: 
For prepaid orders, the amount will be credited to the payment source. Upon product return under our 15 Day Money Back policy (not applicable on coins), the refund will be credited to your account.

8. Applicable Laws

Use of this website shall be governed by the laws of the state of Delhi, India. The parties agree that the courts located in Delhi, India, shall have exclusive jurisdiction over all controversies arising under this agreement. As per Indian government guidelines, customers must provide their Permanent Account Number (PAN) for all purchases above INR 2 lakh in a day.

Free Gift

All free gifts are treated as discounts. In case of partial cancellation or returns of orders with a free gift, the amount refunded will not include the discount attributed to the free gift.

Special Offers

Special offers are valid only on select jewellery designs.
BLING may change (add, delete, or amend) these terms from time to time.

All disputes related to the products and services offered in connection with this agreement are subject to Delhi jurisdiction.

Placing Orders Order Process

Any user wishing to make a purchase may be required to register on the Website after adding the item(s) to the shopping cart. The User may be asked to provide mandatory information required under law, such as the Permanent Account Number (PAN) and/or GST number at the time of purchase.

Orders are considered complete only after payment has been received by the Company, unless otherwise stated.

To confirm the orders, the Company may randomly call the User who has placed orders through the Website and ask a verification question. The Company will confirm the order only after the verification question is answered by the user.

Payment and Fraud

The Company uses third-party payment gateways for billing and payment collection. The user can opt to pay online via our secured third-party payment gateway provider. The user hereby agrees and accepts the terms and conditions as well as the privacy policy of the payment gateway provider.

The user agrees, understands, and confirms that the credit card details provided for availing of services on the website are correct and accurate and that you will not use a credit card that is not lawfully owned by you. Further, the information will not be utilized and shared by BLING with third parties unless required for fraud verifications or by law, regulation, or court order. BLING will not be liable for any credit card fraud. The liability for fraudulent card use will be on the user, and the onus to ‘prove otherwise’ shall be exclusively on the user.

BLING reserves the right to recover the cost of goods, collection charges, and legal fees from persons using the website fraudulently. The Company reserves the right to initiate legal proceedings against such persons for fraudulent use of the website and any other unlawful acts or omissions in breach of these terms and conditions.

9. Availability and Delivery

Product Availability

We will endeavour to fulfil your order once completed and paid for. If a product becomes unavailable after your order has been confirmed and paid for, we will refund the price you paid for the product within 21 business days following the date of payment. If your order includes temporarily unavailable products, we will send the available products first and follow with the outstanding items once they are available. We will refund the shipping fees for the rest of the order. If relevant, we will offer you a replacement product of equal price and quality. If you decline this offer, and the original product is permanently unavailable, we will reimburse the price of the unavailable product.

Shipping and Delivery

BLING will endeavour to respect the delivery schedule indicated on the Website. However, we cannot be held responsible for late delivery or loss of a package caused by a third-party contracted to make delivery, or by you, or due to unforeseen events or Acts of God. If you do not receive your package, an investigation will be conducted with the logistics partner and may take several days upon receipt of your claim. During this investigation, no reimbursement or re-delivery will take place.

At the time of placing the order, the user shall state the full name of the recipient as stated in his/her government-approved photo identification. At the point of delivery, the recipient shall collect the product by furnishing any one of the following Government approved photo identification cards:

Aadhar Card
Driver’s License
Permanent Account Number (PAN) card
Voter’s Identification card
Passport

Delivery shall be made by the company/courier agent only after the photo and name of the recipient are verified and confirmed. The recipient must cooperate with the courier agent by providing valid copies of their government-approved photo identification.
 If the user wants another person to receive the delivery on their behalf, they must specify details at the point of ordering. All items shall be delivered directly to such person. Under any circumstances, the user cannot change the recipient details after the order is processed.

The user has the option to change the shipping address before the product is shipped. If the user wishes to change the shipping address, they must log in to their user account on the website and click on the “Change Shipping Address” button next to the shipping address. This “Change Shipping Address” icon will be active only until the order status changes to “Shipped.” Once the order status changes to “Shipped,” the “Change Shipping Address” link becomes inactive.
All shipping charges and other local charges shall be borne by BLING. The recipient accepting delivery should carefully examine the package and not accept deliveries where the packaging is tampered with. The recipient also has the option to open the package and check its contents before accepting the delivery or signing the delivery receipt. They should not accept deliveries if the box is empty, the contents are damaged, or the contents do not match the order. The recipient, upon signing the delivery receipt, acknowledges the receipt of the product as per the order placed with BLING.

BLING is not liable to the customer/recipient for any refund/replacement under any circumstance for any subsequent complaints regarding such deliveries. If the recipient is not available at the time of delivery, the company/courier agent will attempt to deliver the item thrice before returning it to the company. All costs for re-shipment and handling in the case of non-delivery to the User shall be chargeable to the user.

10. Product Certification

Certifying Our Products

Diamonds set in jewellery, will be accompanied by individual certificates issued by an independent third-party certifying authority. The details of the certificate will be provided at the time of purchase.

Jewellery / Mounts

Diamonds in jewellery or mounts will not be individually certified unless expressly stated at the time of placing the order. The entire jewellery piece will be certified either by an independent third-party certifying authority or by blingdiamonds.in, depending on the value of the jewellery.

Buy-Back And Exchange

The Company offers a lifetime exchange and buy-back policy for products sold exclusively within India, subject to a review by the BLING’s Quality Assurance Department. The product
must be free from any damage, wear, alteration, or resizing. The decision of the Quality Assurance Department shall be final and binding regarding any exchange or buy-back request.

For any life-time exchange or buy-back, the following documents and items are required:

Original product.
Original or copy of the invoice.
Product certificate.
Valid government-issued ID proof of the person making the buy-back or exchange request.

In the event of shipment of the product to BLING under the life-time exchange or buy-back scheme, the product should be securely packed and sealed to prevent any damage during transit, either bubble-wrapped or in a small box or padded envelope.
For re-shipping the products under the life-time exchange or buy-back scheme, the products must be shipped exclusively with our designated shipping partner BlueDart.

Clarity-Based Classification

In the event that the diamond clarity, as stated on a certificate issued by either the Solitaire Gemmological Laboratories (SGL) or the International Gemological Institute (IGI), is “VVS-VS”, all such diamonds incorporated in jewellery manufactured by BLING shall be classified and treated as “VVS” clarity for all commercial, transactional, and valuation purposes.

Sale Transactions: The pricing applicable to “VVS” clarity diamonds shall apply at the time of sale irrespective of whether the original certification indicates “VVS-VS”.
Buyback and Exchange: For the purpose of buyback or exchange, “VVS” clarity pricing shall be applied irrespective of whether the original certification indicates “VVS-VS”.

Terms And Conditions For The Life-Time Exchange Scheme

BLING offers upto 100% exchange policy to end customers. Under this scheme, goods can be exchanged for another item of equivalent value to the selling price of the original goods.
Upon accepting goods for exchange, BLING will provide goods of the same value as the exchanged item. No monetary refunds will be issued.
The goods being exchanged must be accompanied by the original certificate, original invoice provided by BLING.
BLING is not liable for any consequential loss or damage to jewellery or precious stones in studded jewellery.
The life-time exchange policy does not apply to products sold outside India.
The exchange is subject to a quality check conducted by BLING.
An additional logistics fee of ₹1,000 will be deducted when determining the exchange value.
The new order will be shipped within 21 business days after receiving the product at our registered office/authorized store.

Terms And Conditions For The Life-Time Buy-Back Scheme

BLING provides a buy-back scheme allowing customers to return goods to BLING for a refund.

The refund will comprise:

100% of the prevailing market price of gold or any other metal used.
Upto 80% of the prevailing market price of the specific quality of lab-grown diamonds studded in the jewellery.
Any discounts given during the original purchase will be deducted from the market value of the lab-grown diamonds.
Making and certification charges will be deducted when determining the buy-back value.
Refund amount will exclude all taxes applied at the time of purchase.
Buy-back scheme and payment reimbursement are subject to a quality check conducted by the BLING.
Goods must be accompanied by the original certificate, original invoice provided by BLING.
Buy-back policy does not apply to products sold outside India.
An additional logistics fee of ₹1,000 will be deducted when determining the buy-back value.
All buy-back payments by the Company will be made via RTGS or NEFT only, and will be made to the person/entity mentioned in the invoice issued by the retailer, carrying a valid government-issued photo ID and valid certificate of the goods.
Refunds and payments under the buy-back scheme will be processed within 21 business days after receiving the product at our registered office/authorized store.
